Here's a suggestion to Adam Ozimek of *Forbes*: When trying to make
your case, never quote a much better article by a much better columnist.
Case in point: Ozzie's article entitled, "The Liberal War on Food
Stamps." Obviously, this is a title that is designed to be provocative by
going for the most ironic sentence and one wrenched 180 degrees from its
polar opposite (that would be the truth). This pro-corporate fuckstick
immediately goes for the jugular by writing,

Scary Stuff
If you're afraid of snakes, Science has found a visceral cause. There
exists in our primate brains something called a pulvinar -- clusters of
neurons specifically designed to make us fear the slithering legless
reptiles.
So I ask myself: do our brains also contain special neuronal pockets making
us fear spiders, bears and sabre-tooth tigers? And before Homo sapiens goes
entirely extinct, will evolution go into speed-dial emergency survival mode
and gift us with a special place in our cerebral cortices which enable us
to spot a slimy politician from a mile away?

From the sound of things, there were problems at some major internet hubs

What was the problem? When could we expect service to resume? TekSavvy

The first time the Cardinals invaded Fenway!
*WEDNESDAY, OCTOBER 30, 2013*
*We take our revenge on Harry The Cat/A visit from Bud and Lou:* This year
marks the fourth time the St. Louis Cardinals have traveled to Fenway for
the World Series.
The first time was 1946, when the Cardinals went to Boston for games 3-5.
Years later, David Kruh wrote a book about Boston’s entertainment district,
the old Scollay Square, which is of course long gone.
What happened when the Cardinals hit town that year? In his fascinating
book, Kruh reprinted someone's reminiscence about an event which transpired

Maintenance Work In Southern Iraq Causes Planned Disruption In Oil Exports For Sep 2013
September and October 2013 saw major maintenance work on Iraq’s ports in
Basra which account for the vast majority of the country’s oil exports.
That caused a decline in sales for September, but prices remained high, and
the flow through the southern pipeline was actually higher than scheduled.
At the same time two oil fields came on line, and there are continued plans
for a large expansion in production and exports by the end of the year into
2014. Iraq’s petroleum industry is steadily moving forward, but not at the
tremendous rates originally predicted.

There are important differences between immigration and the clean CR needed

Proof Leaked, But NSA Insists Spying on Spain, France ‘False’Clapper: All
Spying Was for 'Valid' Purposes

Reports in Le Monde and El Mundo alleging broad NSA surveillance of French
and Spanish citizens didn’t come out of thin air, but rather were a product
of Edward Snowden’s leaks. The documents associated with those stories were
also published alongside the reports.
So once again the cat is out of the bag, and once again the NSA is
scrambling to issue blanket denials, insisting that the documents were

Alex Sink Is Running For Congress
The big news in Florida this morning wasn't exactly a surprise. After
Florida's former chief financial officer and Democratic gubernatorial
candidate, Alex Sink, expressed interest in running for the open
congressional seat in Pinellas County (FL-13), she became the focus of all
Democratic attention. And when former candidate Charlie Justice and
potential candidates Janet Long and Ken Welch said a few days ago they
weren't running, it was widely assumed Sink had let them know she was in.
This morning Adam Smith at the *Tampa Bay Times* let everyone else know.
Sink, who lives in ne... more »
His Luck Is Running Out
There's a scene in *It's A Mad, Mad, Mad World* where Jonathan Winters
destroys a gas station and two of its attendants. As the Senate debacle
unravels, the prime minister -- consumed with rage -- looks more and more
like Jonathan Winters on a rampage.
At the end of the scene, having obliterated the building and its
inhabitants, Winters hops in a tow truck and drives away, unscathed.
Lawrence Martin suggests that things will not work out that way for Stephen
Harper:
But the list is long and Harper’s odds are not good. There is a common
thread running through his governance, a p... more »

¤ YESTERDAY IN GOLD & SILVER
The gold price was under quiet selling pressure during the Far East trading
session on their Friday, and that continued right up until 1:10 p.m. BST in
London, which proved to the be the low price tick of the day. From that
point, the gold price rallied quietly for almost the entire Comex session
when it opened 10 minutes later. The rally ended/got capped shortly after
1 p.m. EDT, and about 20 minutes before the Comex close. After that, gold
didn't do much.

Academic decisions subject to judicial review but not appeals
*Mortazavi v. University of Toronto, *2013 ONCA 655:
[4] We see no basis for interfering with the motion judge's
exercise of discretion in this case. The original Statement of Claim was
long, convoluted, repetitive and confusing. Crucially, once the 187 pages
is pruned to its essential core – not an easy task – what is left is an
attack on a series of academic decisions relating to admission, enrolment,
leave of absence, grades, and appeals. In these circumstances, the motion
judge had ample justification to conclude, as he did, that "the lawsuit for
the tort or the br... more »
Causation in homicide
*R. v. Manasseri*, 2013 ONCA 647:
[44] The causation requirement in cases of unlawful homicide emerges
from the combined operation of sections 222(1) and 222(5) of the *Criminal
Code*. A person commits homicide when that person, directly or indirectly,
by any means, causes the death of a human being: *Criminal Code*, s.
222(1). A person commits culpable homicide, an unlawful killing, when that
person causes the death of another by means of an unlawful act: *Criminal
Code*, s. 222(5)(a).

cases of u... more »
The Structure of Jury Charges
*R. v. Huard,* 2013 ONCA 650:
[51] In jury charges, substance controls. Form, not so much. No
particular approach or standard formula is compulsory. Provided the charge
fulfills its purpose and satisfies its requirements, the manner in which it
does so is of no great moment: MacKinnon, at p. 386. That said, an orderly
or systematic approach to final instructions seems more likely to enhance a
jury’s understanding of the precise nature of its task and how to discharge
it by following a series of logical steps corresponding to the essential
elements of the offence charged.
