My employer has filed for chapter 11 bankruptcy and is reorganizing. Does
this also invalidate their employment contracts?

This is a good question, Wayne, especially considering how many
bankruptcies have been filed in the past few years. I should first say
that, being an employment lawyer, what I don't know about bankruptcy law is
a whole lot. However, I'll do my best to explain why there's no easy answer
to this question. If there are any bankruptcy lawyers out there who want to

In 1776, when a group of 13 British colonies broke off from their

First, there needed to be a rationale or philosophy that the rest of the
world (Europe, in particular) could embrace for such a revolt. The

Via Lawyers, Guns, and Money, we learn of the international campaign
unleashed by the audacious choice of the Nobel prize committee to give the
literature prize to dissident Canadian writer Alice Munro:
State media in Canada reacted positively to the news, calling it a great
victory for the Canadian nation and the state ideology. Still, Munro is
expected to come under intense pressure from Canadian exile communities,
who are already calling on the author to use this moment to focus greater
attention on the lack of political freedoms in Canada.

Elsewhere: Shutdown/Debt Limit, Gerrymandering, more
Today I did a notes-style post while waiting for details of whatever the
House is going to do on the debt limit, covering some of the next steps on
shutdown/debt limit.
Earlier I argued that it's still all about mainstream conservatives House

Here's some more:
Gerrymandering didn't break the House.
The basic story: Democratic unity.

All in all, a pretty ridiculous display. But note what Obama doesn't

Iraq files a 12,000-page weapons declaration with the UN in order to meet

Who is to blame for energy price rises? “Yes, there are upward pressures on energy bills, and that makes life difficult for people, including those in fuel poverty, but it is right that we go down the low-carbon energy route.”
Despite what Ed Milibnad said in his BBC Watchdog interview last night,

Governing Through Ungovernability
It's 2011 all over again. House Republicans are once more threatening to

Unlike 2011, the government is shut down, throwing hundreds of thousands of

Theoretically, breaching the debt limit doesn't mean the U.S. needs to
default on its debt.
Those who are sympathetic to debt ceiling brinksmanship rightly point out
that the U.S. has way more tax revenue coming in each day* than it has to
pay each day in interest payments, and so therefore the U.S. does have the
financial means to be good on its debt obligations without incurring more
debt.
The argument is that after the debt limit is hit the Treasury can

Gold news - October 9 , 2013 - Big news of the day is the relentless importation of gold by China . Data for August reveals 300 tons of gold imported into Hong Kong with another 110 tons into the Chinese mainland ! Even more interesting , note US and Switzerland were the two largest exporters of gold to Hong Kong . If China and India imports represent 90 percent of world production and with other central banks also buying gold , is there any surprise we have seen World Bank data reflecting the incredible shrinkage of western physical gold - but where is the gold coming from to meet that demand from non Chinese and Indian Central Banks ?

Former Italian Prime Minister Silvio Berlusconi
This guy amazes me. He knows how to enjoy his life. Eat your heart out Hugh
Hefner.
*GRIMACING: Former Italian Prime Minister Silvio Berlusconi held his head
on Wednesday at the Senate in Rome before Prime Minister Enrico Letta’s
confidence vote at the Parliament. After days of political chaos, Mr. Letta
won the confidence vote when Mr. Berlusconi abandoned his bid to topple the
government at the last minute. (Filippo Monteforte/AFP/Getty Images)*
Baling out
Justifiably provoked by the BBC’s biased reporting, many of the
commentariat over at our former haunting ground (B-BBC) have an
overwhelming desire to vent their spleen. Some of the most enthusiastic
contributors would fall over themselves in the rush to pick up the ball and
run with it. In their haste they might ride roughshod over nuance and
subtlety and, frankly, get pretty out of control. Being discredited by
one’s supporters is like being sent flying by a big dog who’s only trying
to make friends.
An unintended consequence of being, may I call it ‘hoist by ones own

Murder and Intoxication
R. v. Gregory, 2013 NSCA 102:
[14] Turning first to intoxication, “drunkenness” is not really a defence
to a criminal act. It is a suggestion that, due to the consumption of
alcohol, or other mind altering substances, the Crown cannot prove beyond a
reasonable doubt the necessary mens rea to establish criminal liability. In
the absence of such evidence, the trier of fact is entitled to apply the
common-sense inference that a sane and sober person intends the natural
consequences of his or her actions.
[15] In terms of the offence of murder, consumption of intoxicants could

Well-supported: People pack the Cinelandia square during the march in Rio

Brazil faces a challenging security situation as it gears up to host the
World Cup in eight months’ time.
In June thousands of demonstrators, angered by the billions spent in
preparations for the event, clashed with riot police near the Mineirao
Stadium in Belo Horizonte.
'We don't need the World Cup,' said Leonardo Fabri, a 19-year-old
protester, at the time. 'We need education, we need better health servic... more »
Counting Backwards (I Count You In)
Grover Norquist is pretty much right about the basics about the 2012
nomination process:
After the speech, he said only three of the Republicans seeking the
nomination were really running for president: Mitt Romney, Tim Pawlenty and
Rick Perry.
“In 2012, we had ten people up on stage. Three of them were running for
president, the others were looking to sell books or be radio talk-show
hosts or marriage counseling or something, but they weren’t running for
president,” he said.
Pawlenty, the former Minnesota governor, showed he was genuinely running
for president because he quit th... more »
We Move About in a Bubble
Two
posts in a row inspired by a Rosie DiManno article.. This is a trend
that has to stop.
I have a simple observation. As a general rule, drivers are not thinking
of cyclists and pedestrians, cyclists are not thinking of pedestrians
and drivers and pedestrians are not thinking of cyclists and drivers.
I drive, walk and cycle and have come to the conclusion that 1 in 5
people are inconsiderate
Civil Disobedience
Civil disobedience is the active, professed refusal to obey certain laws,
demands, and commands of a government. Henry David Thoreau's essay of the
same title is required reading. It's readily available; Southern Man's
e-copy was free at the Kindle Store. And we are - happily - seeing more and
more civil disobedience as citizens push back against a tyrannical
government who confuses a cessation of non-essential services to
barry-cading open-air parks and monuments and even shutting down
privately-funded facilities that just happen to lease their lots from the
Feds. And the shutdown ... more »
Meltdown not happening
I am a student of history, thus I have some perspective. If you ask me are
we on the verge of a great collapse, I could answer nothing but yes.
However we have so many reality distorting facilities in place that we
should not worry. Understand that the world economic system is based upon
fantasy. The only way our model could fail is for some body go rouge. So we
will muddle through this, and in history it will be same old same old.
Thought of the Day
I think we can all agree that Obama Care largely created the Teabagger
majority in the House in 2010. It'll also cost them that majority in 2014.
The Gas Plant Scandal
I wonder how much was incompetence and how much was corruption. Because
when you spend a billion dollar the cracks are very absorbent and hard to
detect.
As I understand it the liberal government made the brave decision to shut
down coal. The conservatives would not have done this but I expect the NDP
would have been all for. Coal is a cheap way to produce power, BTU per
dollar its great. However everything else is bad, mercury pollution alone
is reason enough to shut down these killers. Even if you can scrub the
heavy metals its still a green house gas gasbag. There is another elem... more »
The Brothers
When we think about contemporary brothers wreaking damage on America it's
natural to immediately focus on the John Bircher extremists, David and
Charles Koch, the billionaires financing a relentless campaign against
American democracy itself. If they're successful, history will remember
them as two of the most vile and destructive characters in American
history. But this post is about two different brothers from David and
Charles and set in a time many *DWT* readers may not have been following
politics or even born yet.
Right now I'm reading two books about characters in American ... more »

*Osvaldo Murray: The Man-Birds of Chile*
*(From Revista Revelación, Santiago de Chile, May 1996 pages 10-13)*
There are some incredible stories, and this is one of them. So incredible
that not even I believe it, but the facts are there and I am not going to
change them, no matter how skeptical one may be.
The start of this story kicked off – as a sort of byproduct of terror – of
an equally incredible story: the death of a young woman in what the
Catholic Church described as demonic possession.
And I believe it in the sum total of the fantastic, despite the fact that I
myself have... more »
Open Letter on Fusion
Over the past decade, research on alternate fusion protocols has blossomed
while the one off Tokomak approach has swallowed financial and human
resources to modest effect. There is a simple answer of course. Just
demand that Tokamak receive fifty percent private financing and do the same
for all other protocols. This will quickly reapply capital broadly to the
thriving protocols.
This is essentially what happened to NASA and we have been smiling ever
since.
Seven years ago there were a handful of protocols sitting mostly dead in
the water. That has changed. It has... more »
Cheaper Grid Battery
We do not get a lot here, including the all-important energy density.
Otherwise it appears promising and deliverable so we will likely see more
of this company. I do like the lack of an acid solution for the system
itself as that ends no end of operational difficulties.
Vanadium Redox has not gone away either, so the age of utility grade
energy storage is fast approaching. Flow batteries are the natural fix
there.
This particular aspect of grid architecture is the low lying fruit of our
grid system. A storage option hugely increases grid capacity.

Oldest Petroglyphs in North America
The postulate here of an extreme gamma ray burst is certainly interesting,
but does not support the momentum transfer absorbed by the crust at the
time and supported by masses of conforming geological evidence. Yet this
may well have happened during the longer time window that includes the
Pleistocene Nonconformity and brings in evidentiary confusion. We may have
had two major events with the plasma event been dramatic and clearly
survivable. That we have linked petrography is compelling for ready
survival.
What is important is that the pinch glyphs are accurately... more »

*It is plausible that some cattle mutilations are caused by natural
attacks from an unidentified creature such as my posited gargoyle. Yet ten
thousand animals over several years mostly demonstrating surgical sampling
techniques is nothing of the sort.*
*More important however in this report is that we get confirmation of
alien monitoring of our communications. I have suspected as much simply
because it is a natural to need to establish ground truth.*

Hell Froze Over - #VoteNo2ALEC
Campaign season has started.
As a Dem precinct chair here in MN I get a lot of campaign emails.
People looking for support for the upcoming primaries and for party
endorsement.
Have to admit - I delete these from my email box - 99% of the time I just
delete them.
Cause I research the candidates, not just accept their promos.
For unknown reason - universe knocking at my door - I opened the email I
got last night.
And then
*had* to do a little research.

Invest in libraries, not more tests
Sent to the Houston Chronicle, October 9
Lisa Falkenberg ("Cutting libraries shows warped priorities," October 9) is
right: Spending money on increased testing while cutting libraries and
librarians is like investing in precise scales to weigh the animal, but
neglecting to feed it.
Decades of research show that the most important factor in developing
literacy is self-selected reading, or reading because you want to. For
children of poverty, the library is often the only place they have access
to books.
We hear pious pronouncements from politicians about the importance of
reading... more »
