Abandonment a defence in Canada
R. *v.* Gauthier, 2013 SCC 32 upholds the defence of abandonment from a
common intent to commit a crime.
Many, including this writer, doubted such defence existed in Canada. Well,
it does and the Court holds:
[38] Thus, it was held that a defence of
abandonment has three essential elements: (1) there must be an intention
to abandon or withdraw from the unlawful purpose, (2) there must be timely
communication of this abandonment or withdrawal from the person in question
to those who wish to continue, and (3) the notice so communicated to those

Is this the most awesome early Soviet propaganda poster ever? It has
everything - Lenin rising up from the masses, clearly gesticulating the
young workers' republic's line of march. And demonstrating the fruits
socialist industry unleashed, you have the immense modernity of the airship

reads "Let's build a fleet of airships in Lenin's name", or, "We will build
Lenin's escadron [squadron] of airships", depending on who you believe.
Whatever, I'm sure it sounds perfectly rousing in the original Russian. You

The calamitous B.C. May election is over. A full-scale, grass-roots
eruption should have taken place – with the whole province watching as the
NDP Top Twenty were publicly disgraced, disowned, discarded, dismissed ...

fundamental tax revision, dogged pursuit of Campbellclark lawlessness,
major policies of re-regulation and provincial ownership through Crown

“George Orwell said, “Good prose is like a windowpane. I cannot say with
certainty which of my motives are the strongest, but I know which of them
deserve to be followed.” For him, the strongest impulse was political
change. The author of 1984 and Animal Farm, having experienced first hand
the effects of government control, wrote with an innate determination to

be that Orwell wrote to push back against totalitarian g... more »

The White House response to the revelation that the NSA is collecting
massive amounts of phone "metadata" from Verizon is that this is a vital
"anti-terrorism" tool. But if collecting data from Verizon is a key
anti-terrorism tool, then surely collecting it from AT&T, Sprint, T-Mobile,
and everyone else would be an even better anti-terrorism tool. And if
collecting metadata is providing essential anti-terrorism information,
think how much more anti-terrorism information could be gleaned by
recording the actual "data" (that is, the conversations that are taking
place)? Not to mention... more »
Shocked to learn there's surveillance going on in this place
Anybody who's old enough to have been paying attention shouldn't be
surprised to learn the huge telecom data sweeps are still going on
unabated. Adding, I'd be willing to bet it's not only AT&T who's
