By Robert Henneke The U.S. Supreme Court has already held that the individual mandate absent the tax penalty is unconstitutional. Now that Congress has set the tax penalty at zero, it no longer performs the essential function of a tax, which is to generate revenue for the federal government. Under the Supreme Court's own analysis in the *NFIB v. **Sebulius* case, there is no remaining legal basis on which to uphold the individual mandate, which cannot be severed from the Affordable Care Act as a whole. BREAKING: An unusual moment of self-loathing!
*WEDNESDAY, APRIL 25, 2018Three letters in the Times:* We just ordered Amy Chozick's book. This has produced a rare moment of self-loathing. Aside from that, consider yesterday's trio of letters. Try to place them in the context of modern journalistic history. In last weekend's Sunday Review, the Times let Chozick spout and prattle about her new book. Three letters about her essay appeared in yesterday's Times. Needless to say, all three beat up on Candidate Clinton. You can read them here. The Travel Ban at the Supreme Court: Deference Seems to Prevail
From today’s Supreme Court oral argument in *Hawaii v. Trump*, it appears that deference to executive judgments about foreign policy and national security has carried the day on President Trump’s travel ban (EO-3). Apart from Justices Sonia Sotomayor and Ruth Bader Ginsburg, all of the justices seemed to some degree to credit the government’s contention that EO-3 emerged from a deliberative interagency process to improve foreign governments’ information practices regarding their nationals’ entry into the United States. While it can be risky to predict the outcome of cases based... more »

Len McCluskey on Labour Anti-Semitism
Len McCluskey has played a blinder. Read his article for yourself. He doesn't give the impression, which he has in the past, that Labour anti-semitism is a put up job. He explicitly addresses it. Rightly, he contextualises it as an excrescence, a minority pursuit to be dug out and thrown out using the enhanced powers the party has adopted. And what he does is to give voice to the frustrations and anger rippling through the party membership about Labour's other big problem, the Parliamentary Labour Party problem. Despite achieving in two years what it took Kinnock nine years to do (... more »

Does the Corker-Kaine AUMF Bill Really Open the Door to War with North Korea and Iran?
Senator Bob Corker (Credit: Flickr/Embassy of Moldova) That’s the remarkable claim purveyed this morning in a New York Times editorial. Here is the relevant passage: Although the bill’s supporters say no country could be considered an ‘associated force’ under the proposal, some critics fear that it could be used by the Trump administration to go to war against Iran or North Korea, both of which the United States considers to be state sponsors of terrorism. Now that liability for corporations (foreign ones, at least) under the Alien Tort Statute (ATS) is off the table, the recriminations can begin. Tuesday’s Supreme Court decision in *Jesner v.
