Rudy Giuliani on the Stand
The President's lawyer will be a star witness in the impeachment trial. His
testimony, though, will present several challenges for Chief Justice
Roberts and for the Senate. Let me run through some.
1. Can Rudy defend the President in the trial if he is also a witness?
In an ordinary trial, the answer would be no. Here I suppose the Chief
Justice could allow Giuliani to perform both roles with the caution that
this might be bad for the President's defense. But he could, I would think,
also bar him from being a lawyer on the Senate floor.
